1. INTRODUCTION AND ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") govern your use of the Mamilla mobile application (the "App") operated by Mamilla Limited ("Mamilla", "we", "us", or "our"), Company Number 15795330, registered at 167-169 Great Portland Street, 5th Floor, London, W1W 5PF, United Kingdom.

By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

2. ELIGIBILITY

You must be at least 16 years old to use the App. By using the App, you confirm that you meet this requirement.

 

The App is designed for people who are pregnant, breastfeeding, or supporting someone who is. It is intended for personal, non-commercial use only.

3. THE APP AND ITS CONTENT

3.1 What Mamilla Provides

Mamilla is a breastfeeding education and support app. It provides:

  • Learning sessions covering breastfeeding techniques, positions, and hand techniques

  • Troubleshooting sessions to help you understand and address common breastfeeding challenges

  • Signs That sessions to help you recognise symptoms and situations relating to breastfeeding being painful

  • Tips personalised to your stage of motherhood

  • A personalised home screen based on your baby's age and your individual breastfeeding experience

3.2 Not Medical Advice

THE CONTENT PROVIDED THROUGH THE APP IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. NOTHING IN THE APP CONSTITUTES MEDICAL ADVICE, A CLINICAL DIAGNOSIS, OR A RECOMMENDATION FOR MEDICAL TREATMENT. MAMILLA IS NOT A MEDICAL PROVIDER AND DOES NOT REPLACE THE ADVICE OF A QUALIFIED HEALTHCARE PROFESSIONAL, LACTATION CONSULTANT, OR MIDWIFE. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN THE APP.

If you have any concerns about your health or your baby's health, you must seek advice from a qualified healthcare professional. In an emergency, call 999 or your local emergency number.

3.3 Accuracy of Content

We take care to ensure the content in the App is accurate and up to date. However, we do not warrant that all content is complete, accurate, or current at all times. Breastfeeding guidance and clinical recommendations may change, and you should always cross-reference important health decisions with a qualified professional.

​

3.4 Use at Your Own Risk

Our goal is to make breastfeeding education and support more accessible. However, the App cannot and does not guarantee any particular health-related outcomes. Your use of the App and any information, suggestions, or guidance provided within it are at your sole risk. The App is not intended to match or serve the same purpose as advice from a medical or clinical professional.

4. ACCOUNT REGISTRATION

  • To use the App, you will need to create an account. You agree to:

  • Provide accurate and complete information when registering

  • Keep your account credentials secure and not share them with anyone else

  • Notify us immediately if you become aware of any unauthorised use of your account

  • Take responsibility for all activity that occurs under your account

You are responsible for taking all reasonable steps to ensure no unauthorised person has access to your account or password. If you believe your account has been compromised, please contact us immediately at info@mamillabreastfeeding.com.

​

We reserve the right to suspend or terminate your account if we reasonably believe your account information is inaccurate, or if you have breached these Terms.

​

5. PRICING AND FUTURE PAID FEATURES

The App is currently free to use. We may introduce paid subscription tiers in a future version of the App. If and when we do, we will update these Terms accordingly and give you reasonable notice before any charges apply. You will never be charged without your explicit agreement at that time.

6. INTELLECTUAL PROPERTY

All content within the App, including but not limited to text, images, graphics, illustrations, session content, tips, and the overall design and structure of the App, is owned by or licensed to Mamilla Limited and is protected by copyright and other intellectual property laws.

 

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the App without our prior written permission. Permission requests may be sent to info@mamillabreastfeeding.com.

 

By using the App, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the App for your own personal, non-commercial purposes in accordance with these Terms.

7. ACCEPTABLE USE

You agree not to use the App to:

  • Violate any applicable law or regulation

  • Attempt to gain unauthorised access to any part of the App or its underlying systems

  • Interfere with or disrupt the App or servers connected to it

  • Reverse engineer, decompile, or disassemble any part of the App

  • Copy, adapt, alter, or create derivative works of the App without our written authorisation

  • Use the App for any commercial purpose without our written consent

  • Submit false, misleading, or inaccurate information

  • Impersonate any person or entity

  • Upload or transmit any content that infringes the rights of any third party

  • Upload any material containing software viruses or any code designed to disrupt or damage any

  • system

  • Use the App to advertise, solicit, or transmit unsolicited commercial messages

Any such forbidden use shall immediately terminate your licence to use the App.

​

8. USER-GENERATED CONTENT

Mamilla does not currently offer community or social features. If such features are introduced in a future version of the App, separate terms governing user-generated content will be provided at that time and will form part of these Terms.

​

9. THIRD-PARTY SERVICES

The App may integrate with or link to third-party services, including Apple for authentication.

​

We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their own terms and conditions.

​

10. USE OF MOBILE DEVICES

The App is designed for use on iOS mobile devices. Please note that your mobile carrier's normal rates and fees, such as data charges, will still apply when using the App. We are not responsible for any charges incurred from your mobile carrier in connection with your use of the App.

11. FEEDBACK

We welcome your feedback about the App. Unless otherwise expressly agreed, any feedback or suggestions you send to us are submitted on a non-confidential basis. You agree that we may use such feedback freely for any purpose,  including improving the App, without any obligation to compensate you.

​

12. CHANGES TO THE APP

From time to time and without prior notice, we may change, update, or improve the App. We may also at any time cease to operate part or all of the App, or selectively disable certain features. Your use of the App does not entitle you to the continued provision or availability of any particular feature. Any modification or removal of features will be made at our sole discretion.

13. COPYRIGHT AND NOTICE OF INFRINGEMENT

If you believe any content accessible through the App infringes your copyright, please contact us at info@mamillabreastfeeding.com with the following information:

  • A description of the copyrighted work you believe has been infringed

  • A description of where the infringing material appears in the App

  • Your name, address, and email address

  • A statement that you have a good faith belief that the use is not authorised by the copyright owner

  • A statement that the information you have provided is accurate and that you are the copyright owner or authorised to act on their behalf

We will review all valid notices and take appropriate action in accordance with applicable law.

​

14. DISCLAIMER OF WARRANTIES

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Mamilla makes no warranties, express or implied, regarding the App, including but not limited to:

  • That the App will be uninterrupted, error-free, or free from viruses or other harmful components

  • That the App will meet your specific requirements

  • That any content in the App is accurate, complete, or suitable for your particular circumstances

​

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

​

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mamilla Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising out of or in connection with your use of the App.

 

Our total aggregate liability to you in connection with these Terms or your use of the App shall not exceed £100. Mamilla and any third parties mentioned in the App are not liable for any personal injury, including death, caused by your use or misuse of the App.

We are not liable for any health outcomes arising from the use of educational content within the App. You should always seek professional medical advice for health-related decisions.

​

16. INDEMNIFICATION

You agree to indemnify and hold harmless Mamilla Limited and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App or your breach of these Terms.

​

17. TERMINATION

We reserve the right to suspend or terminate your access to the App at any time if we reasonably believe you have breached these Terms, without notice and without liability to you.

 

You may stop using the App and delete your account at any time through the App settings. On termination, your licence to use the App will immediately cease. Sections relating to intellectual property, disclaimer of warranties, limitation of liability, and governing law will survive termination.

18. GENERAL

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited to the minimum extent necessary so that the remaining Terms continue in full force and effect.

 

No waiver by Mamilla of any term or condition in these Terms shall be deemed a continuing waiver of that term or condition, or a waiver of any other term or condition. Any failure by Mamilla to assert a right under these Terms shall not constitute a waiver of that right.

 

Any cause of action you may have with respect to your use of the App must be commenced within one year after the claim or cause of action arises.

 

19. GOVERNING LAW AND DISPUTES

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the

courts of England and Wales.

 

If you have a complaint or dispute, please contact us first at info@mamillabreastfeeding.com and we will endeavour to resolve it informally. If we are unable to do so, either party may seek resolution through the

courts of England and Wales.
